If you live in Puerto Rico and are planning on filing for divorce, there are a few important things you need to know before you initiate the process. For starters, you are going to want to start looking around for a divorce lawyer who is going to be there to guide and support you through the divorce proceedings. USAttorneys.com works with some of the best divorce attorneys in Puerto Rico so you can start your search by contacting us.
The next thing you need to consider is the requirements that must be met in order for your petition for divorce to be processed through the court. A “petition for divorce” or a “dissolution of marriage” are the legal terms that are often used when referring to divorce. One of the things Puerto Rico requires of you is for you to have met the residency requirements before you file for divorce. In order to apply for a divorce, you must have resided in Puerto Rico for at least a year immediately prior to filing the divorce petition.
However, Puerto Rico Code 31 L.P.R.A §331 states that a party may not be subject to the one-year residency requirement if the grounds on which the petition for divorce were committed in Puerto Rico or while you or your spouse were living in the territory.
